　　2018年10月1日，美国国际贸易委员会（ITC）投票决定对特定力量训练系统及其组件（Certain Strength-Training Systems and Components Thereof）启动337调查（调查编码：337-TA-1135），主张对美出口、在美进口及销售的特定力量训练系统及其组件（Strength-Training Systems and Components Thereof）侵犯了其专利权（美国注册专利号US7549949、US7563209、US7594880、US7654938、US7976440）。中国企业山东英吉多健康产业有限公司、美国企业塔夫健身材料国际有限公司2家企业被列名被告。

　　1、涉案专利分析

　　本案涉案专利为US7549949、US7563209、US7594880、US7654938、US7976440，这5件涉案专利互为同族专利，其专利族规模为20件，均为美国专利，且全部为有效专利。

A load resists movement of at least one of the user support, user engagement device, and connecting linkage. The user engagement device is at least partially non-rigid to allow a user to define the path of the handle and thus the type of back exercise performed.

　　3、案件总结及应诉建议

　　（1）积极应诉

　　从企业角度，被告如果不应诉，会被认定为是缺席被告。即使同案其他企业应诉成功，USITC仍会做出缺席裁定，认定对缺席被告的指控是真实的，对缺席被告立即采取救济措施。而应诉后，即使最后和解，也可以增大和解筹码，争取降低赔偿。从产业角度，该案极有可能酝酿着接踵而来的其他337调查，如果立案企业能够轻易达到目的，必会故技重施，我国将会有更多的企业被该立案企业337调查。

　　（2）侵权比对

证明产品不侵权是应诉的首先方案。建议首先进行产品侵权比对，我站将为企业提供侵权比对服务。

　　（3）规避设计

　　如果存在侵权，对涉案专利的技术方案进行研究，找出其在保护范围上存在的漏洞，利用这些漏洞，设计出新的产品或者对此前涉嫌侵权的产品进行改造，从而避开涉案知识产权的保护范围。针对规避设计，工作站给予的重要提示是：涉案的5件专利，在美国的还有其他15件同族专利，规避设计要将涉案专利的其他美国同族、接续案等纳入技术研究范围。
